It's about Massachusetts, but a federal appeals court made the ruling, so I was thinking the same thing might apply to MD, since our law is loosely based on the same premise.
Quote:
"We hold that (the law) violates the Commerce Clause because the effect of its particular gallonage cap is to change the competitive balance between in-state and out-of-state wineries in a way that benefits Massachusetts's wineries and significantly burdens out-of-state competitors," the appellate court wrote in its decision.
Family Winemakers of California, a Sacramento-based group representing about 650 producers, argued the law was "protectionist" and effectively kept 98 percent of domestic wine out of direct reach of Bay State consumers.
I have had both wine and beer shipped to my residence in MD FWIW...

me too. Some places just openly defy the law. Some use third party shippers who are basically smugglers. Some insist that the 3rd party shippers are not the winery and therefore it's legal.
Wine shipped from a vineyard in Napa, and I'm in this beer of the month club. I believe it is greatclubs.com or something like that. Not sure. My girlfriend's mom gets me a 3-month "subscription" every year. I know with the wine, they ship it to PA and then they have a trucking service deliver it that way if I am not mistaken. However, I bought a wine club thing for one of my friends and they received it (MD resident also).

I've heard about people getting alcohol shipped here in "souvenir bottles", where the object you're buying is some sort of gift bottle that happens to have alcohol in it.
my office is in DC, but never really contemplated getting beer shipped. not really a wine guy. what can you get that you can't get at Corridor/Chevy Chase/Perfect Pour that makes up for the cost of shipping?
Anyone who is having wine shipped to their home in Maryland is benefiting from an illegal transaction somewhere along the way. When I lived in Maryland, I used to have wine shipped to my office in DC. Now that I live in WV, I can have it shipped to my home legally.
The ban is supposed to go away in this legislative session...I think Miller is against though since he 'believes' this is a way for kids to get alcohol so it isn't a done deal yet
The prospects for legalizing wine shipping are pretty good this year, especially considering the issue has been around for 29 years, but we still need many more people engaged in this. Please consider signing our petition which will then get forwarded to your elected officials:
I'm surprised companies would risk sending beer/wine to MD through 3rd parties. I mean how much money can beer of the month subscriptions generate that would make it worth the risk/of a fine?
I can see the reason for the law, MD wines for the most part suck and the state is trying to protect them. I guess. But it sure does stink for the consumer and I hope it does change.
